A serviceman from Lutsk was acquitted of punishment for unauthorized leaving the military unit by court order
The Ivano-Frankivsk City Court considered the case of a serviceman from Lutsk who did not report for duty for three days. By the court's decision, the case was closed, and the soldier was acquitted of punishment.
The serviceman faced imprisonment for 5 to 10 years under Article 407 of the Criminal Code of Ukraine.
On October 21, the suspect approached the prosecutor requesting release from criminal liability and return to service.
The prosecutor agreed to support the request since the military committed a criminal offense for the first Time. The military unit commander has given written consent for continuing service
The court closed the criminal proceedings and acquitted the soldier. According to the decision, he must return to the military unit within 72 hours.
Increase in the number of requests from servicemen who want to return to service
After changes in legislation allowing servicemen who have illegally left the unit or deserted for the first time to apply for return to service, the number of requests from such individuals has increased.
However, the mechanism for returning to service is not yet functioning for servicemen who are in detention.
Ukrainian courts believe that individuals convicted of evading conscription during mobilization should serve in the military.
