Ukrainians have the opportunity to pay an administrative fine for another person, even if that person refuses to do so. According to responses from lawyers on the portal Yuristy.ua, Ukrainian legislation does not prohibit a third party from paying the debtor's monetary obligation, including administrative fines for traffic violations. This is confirmed by Article 528 of the Civil Code of Ukraine. Experts emphasize that to correctly pay the fine, several important rules must be followed. 'The most important thing is to correctly indicate the purpose of the payment,' explains lawyer Vladislav Deryi. The payment document must specify: the full name and individual tax number of the debtor; the number of the enforcement proceeding or decision; the wording 'Payment of the fine under enforcement proceeding No. ___ concerning [debtor's full name].' Lawyers recommend keeping the receipt after payment and sending a copy to the enforcement service to avoid misunderstandings and expedite the lifting of restrictions on accounts. Lawyer Andrii Karpenko draws attention to judicial practice: 'If the obligation is placed on a third party by the debtor, the creditor cannot refuse to accept it, as it is presumed that the creditor does not care who fulfills the obligation on their behalf.' It is worth remembering that according to Article 307 of the Code of Ukraine on Administrative Offenses, if the fine is not paid within 15 days, its amount is doubled, and costs for recording violations are added.
